Per curiam, the appellate division finds that attorney Rita Horowitz Altman, sanctioned for misconduct where she lives and practices immigration law in Florida, should be suspended in New York for three years. Altman failed to timely report the discipline in her home jurisdiction, which stretched over nearly 20 years, as well as discipline imposed by the board of immigration appeals based on the Florida misconduct. Meanwhile, her actions in Florida would have qualified for discipline New York.

Cannataro finds that the tax appeals tribunal properly determined that a company's former president and majority shareholder had been responsible for collecting and paying employee withholding taxes. Although relieved of duties by a silent investor, the president had sworn to actual authority and power to pay the taxes at the time, and ample evidence supported the holding that he willfully failed to pay such. Affirmed.

J. Gruber finds the circuit court properly terminated the putative father's rights to his minor child. The child was taken into custody after testing positive for opioids at birth. Though paternity tests have shown that the putative father is not the biological father, he argues that he is a parent under the juvenile code and by his acknowledgement of paternity. DHS found his home could not safely accommodate a child, even after improvements were requested. The child needs the permanency of the foster care she has been in her entire life. She does not know or ask about the putative father, and parental rights will not be enforced in such a circumstance. Affirmed.
